TERMS AND CONDITIONS – CLEAN LINEN COMPANY

1. Introduction
These Terms and Conditions ("Terms") govern the provision of subscription services ("Services") by Florigen Investments Pty Ltd t/as Clean Linen Company ("we", "us", "our") to the customer ("you", "your"). By subscribing to our Services, you agree to be bound by these Terms.
2. Subscription Services
2.1 Our subscription service provides linen products on a recurring basis, including scheduled delivery and collection.
2.2 Subscription entitles you to a fortnightly product changeover service.
2.3 Service schedules, including delivery days, are determined by us based on residential zoning and logistics requirements. We reserve the right to modify schedules where reasonably necessary.
3. Ownership of Products
3.1 All products supplied as part of the subscription remain the property of Florigen Investments Pty Ltd at all times.
3.2 You agree to return all products supplied under the subscription upon cancellation or termination of the Service.
3.3 Failure to return products may result in charges as outlined in these Terms.
4. Fees and Payment
4.1 Subscription fees are charged fortnightly in advance.
4.2 By subscribing, you authorise us to charge your nominated payment method on a recurring basis.
4.3 You must ensure sufficient funds are available. Failed payments may result in suspension or termination of Services.
5. Security Deposit
5.1 A refundable security deposit of $200 is required at the commencement of the subscription.
5.2 The deposit will be refunded at the end of the subscription, subject to:
(a) return of all products; and
(b) inspection confirming no unreasonable damage, loss, or excessive wear and tear.
5.3 We reserve the right to retain part or all of the deposit to cover:
(a) unreturned items;
(b) damage beyond fair wear and tear; or
(c) any outstanding fees.
6. Cancellation and Termination
6.1 You may cancel your subscription by providing seven days written notice.
6.2 We reserve the right to cancel or suspend any subscription at our discretion at any time.
6.3 In the event we cancel your subscription, we will refund any unused portion of prepaid fees.
6.4 Upon cancellation or termination, all products must be made available for collection within a reasonable timeframe.
7. Customer Responsibilities
7.1 You agree to:
(a) take reasonable care of all supplied products;
(b) use products only for their intended purpose;
(c) ensure safe and reasonable access for delivery and collection.
7.2 You are responsible for any loss, theft, or damage to products while in your possession.
8. Missed Deliveries or Access Issues
8.1 If we are unable to complete a scheduled service due to lack of access or other circumstances within your control, the service may be forfeited without refund.
8.2 We may charge an additional fee for re-delivery or additional service attempts.
9. Changes to Services or Pricing
9.1 We reserve the right to vary pricing, product offerings, or service inclusions at any time.
9.2 We will provide at least 14 days notice of any material changes.
10. Liability
10.1 To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising from the use of our Services.
10.2 Our liability is limited to the value of the Services supplied.
11. General
11.1 These Terms are governed by the laws of New South Wales, Australia.
11.2 If any provision is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
11.3 These Terms may be updated from time to time, with the latest version published on our website.
